This document constitutes an electronic record in accordance with the Information Technology Act, 2000 and its related rules. It is published under Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011, which mandates the publication of rules, regulations, privacy policy, and Terms of Use for accessing or using the Website and Application.
1. TERMS OF USE
a. These Terms of Use govern your use of our website www.mealgaadi.com (the ‘Website’) and our Mealgaadi application for desktop, laptops, mobile and handheld devices (the ‘App’), collectively referred to as the ‘Platform’. Please review these Terms of Use carefully before using the services. By installing, downloading, or using the Platform, you agree to be bound by these Terms of Use and other Mealgaadi policies, including but not limited to the Cancellation & Refund Policy, Privacy Policy, and other third party polcies too.
b. The Platform is owned, marketed and operated by Trendonix Infotech Private Limited. By using the Platform, you agree to contract with Trendonix Infotech Private Limited and abide by these Terms of Use.
c. ‘Mealgaadi’, ‘MealGaadi’, ‘Meal Gaadi’, ‘Meal Gadi’, ‘MealGadi’ are all the one and same thing on the platform and would signify the same thing. Trendonix Infotech Private Limited solely holds all the trademarks and rights for the terms used.
d. MealGaadi facilitates transactions between partner or registered restaurants/brands and customers for food and beverage products (‘Platform Services’). Customers can place orders (‘Orders’) or book orders or subscribe orders from various restaurants/brands (“Mealgaadi Partners”) listed on the Platform, and MealGaadi ensures the delivery of such Orders in select localities across India (‘Delivery Services’). Together, the Platform Services and Delivery Services constitute the ‘Services’.
2. AMENDMENTS
These Terms of Use are subject to amendments at any time. We reserve the right to modify these Terms of Use and other Mealgaadi policies by posting changes on the Platform. It is your responsibility to regularly review the Terms of Use and other Mealgaadi policies and note any changes. Your continued use of the services after any amendments implies automatic acceptance of the updated Terms of Use and policies.
3. USE OF THE PLATFORM
a. All offers made by customers are agreements between customers and Mealgaadi. Mealgaadi generally acts as a facilitator for the Food Delivery of its partner Brands, Restaurant and Kitchens.
b. Mealgaadi makes no representations or warranties regarding the products purchased from Mealgaadi. Customers are advised to independently verify the credibility of any Mealgaadi and partner products they choose to book or order.
c. Mealgaadi operates as an online ordering space for food, beverages and related items. We do not hold any right, title, or interest over the products and assume no obligations or liabilities concerning such products.
d. Mealgaadi provides a platform for customers to place Orders, which constitute agreements between the customer and Mealgaadi Partner. Complaints regarding food products delivered should be directed to the relevant Mealgaadi Partner, with Mealgaadi assisting customers in resolving issues to the best of its abilities.
e. We are not responsible for any non-performance or breach of contracts between customers and Mealgaadi Partners. We do not guarantee the performance of any transaction on the Platform and are not liable for unsatisfactory services or delays due to product unavailability.
f. With reference to Mealgaadi partners, they might include Trendonix Infotech Private Limited’s owned and operated Food Chains, Cafes, Restaurants, Kitchens and Outlets. These partner kitchens might act as the product providing agents to Mealgaadi for delivery purposes.
4. ACCOUNT REGISTRATION
a. To access the Platform, you are required to provide accurate registration details and information. Your use of the Platform is contingent upon the correctness, completeness, and accuracy of the information provided.
b. If you opt for a username, password, or any security information, treat it as confidential. Do not disclose it to others, and ensure that your account remains personal. Notify us immediately of any unauthorized access or security breach. Your account is solely for your own use, and you agree not to provide access to others.
c. We may verify the information provided by you, and if found incorrect or misleading, or if you violate these Terms of Use, we reserve the right to disable your account at our discretion.
d. Furnishing false or misleading information may lead to legal consequences under applicable laws.
e. Products and services purchased on the Platform are for personal use only, and you confirm not to use them for resale purposes.
f. For your convenience, basic information such as name, email address, phone number, and location is required. Payment processing involves redirecting you to a payment gateway website for processing relevant payment information.
5. ORDER PROCESSING
a. The Platform allows you to place food orders, and, subject to the terms herein, facilitates order delivery to you. You can also schedule and book the orders in advance. Mealgaadi also offers the Food subscription service wherein you can subscribe to a specific food item for a particular selected number of days.
b. We do not own, sell, or control the Mealgaadi Partner or related services. Orders are subject to the terms outlined in these Terms of Use, including product availability and delivery location serviceability.
c. Generally, food orders placed on the Platform are treated as confirmed. After booking, we may contact you to confirm order details, price, and estimated delivery time.
d. Payment can be made in Indian Rupees through various methods, as specified in the order process.
e. We act as the payment agent for Mealgaadi Partners, and your payment to us satisfies your obligation to the Mealgaadi Partner. Do not make payments directly to the Mealgaadi Partner for orders placed through the Platform.
f. Prices listed on the Platform are determined solely by the Mealgaadi Partner. Prices may change during delivery, and any change is at the Mealgaadi Partner’s discretion.
g. Pick-up/takeaway services are facilitated between you and the Mealgaadi Pilots.
h. Prices, including any additional charges, are determined by the Mealgaadi Partner and are based on the information provided by them.
i. MealGaadi is not responsible for any sort of warranty/guarantee of food products.
6. REFUNDS AND CANCELLATIONS
a. Orders cannot be canceled once placed, except within one minute of placing the order. Refunds may be denied based on cancellation history.
b. Cancellation after one minute may incur a 100% cancellation fee. We reserve the right to refund or recover the order value based on payment status.
c. Cancellation fees may apply for orders canceled by us due to reasons beyond our control.
d. Refunds for prepaid orders, post deduction of cancellation fee, may be processed. Refunds for damaged or incomplete orders will be assessed on a case-by-case basis.
e. Refunds for non-delivery due to our fault may be granted. Decisions on refunds and cancellations done my Mealgaadi are final.
f. All refund amounts will be credited to your account as per the chosen payment mechanism.
g. Payment at the time of delivery is not required for certain conditions, including damaged packaging or wrong orders.
h. No Refunds are appicable after the delivery of the item under any conditions as the commodity of sale is a consumable item and cannot be exchanged or returned back for refund. Decisions on refunds by Mealgaadi are to be treated final.
i. You agree to promptly inform the Platform of any damaged/incorrect/incomplete order.
7. GENERAL TERMS OF USE
a. Use of the Platform is available to those eligible to enter into a legally binding contract. Minors are not eligible, and use must be by a legal guardian or parent on their behalf.
b. Menu and price details are based on information provided by Mealgaadi Partners, and we are not responsible for any changes or cancellations.
c. Delivery timeframes are approximate, and we are not liable for delayed deliveries.
d. Our liability ends upon order delivery to you. Use of the Platform is at your sole risk.
e. Mealgaadi Partners are not endorsed by us.
f. You are responsible for the costs incurred in accessing and using the Platform.
g. You grant permission to receive promotional SMS and emails. Opt-out by emailing contact@mealgaadi.com.
h. You agree to defend and indemnify the Platform against any claims arising from your breach of these Terms of Use.
i. We are not responsible for unauthorized use of debit or credit cards.
j. Mealgaadi reserves the right to alter/withdraw/extend offers/promotions without notice.
8. YOUR REPRESENTATION AND WARRANTIES
a. All information provided during registration must be true, accurate, and legal.
b. Use of the Platform is personal, and no other entity should use it on your behalf. You are responsible for the information in your account and its confidentiality.
c. You represent that you own or are authorized to share the information provided. The information is accurate, complete, not misleading, and complies with laws and regulations.
d. Content submitted must not be defamatory, abusive, offensive, illegal, or encourage illegal activities.
e. You possess all necessary licenses, consents, and rights for submitted content.
f. You will not post harmful software or files that may damage the Platform or interfere with others’ use.
g. You will not use another person’s information or impersonate someone else.
9. MEALGAADI DELIVERIES
a. Mealgaadi would be using professionally trained and skilled delivery partners to deliver food packeges to its customers.
b. Types of Deliveries:
i) Lunch Meal Subscription Deliveries : Such deliveries would be made daily between 11:30 am and 1:30 pm. Meal trays would be delivered daily for selected days and frequency to your location. Deliveries would be generally made using the bulk-delivery model and hence no specific personal requests such as preferred timings or others would be entertained.
ii) General Order Delivery : Customers can place general food orders at any time within the operable hours and receive orders within a stipulated time which generally includes Order Acceptance time, Preperation Time, Packing Time and Delivery Time. This ranges generally between 20 minutes to approximately one hour and depends on various factors such as Type of Order, Quantity and Location.
iii) Scheduled Orders : Customers can also get an option to place scheluded orders in which they can choose a date of future to place the order of their choice.
c. Depending on various factors you may or may not be charged some delivery and package handling fees. These fees would be displayed while checking out clearly. These fees might change with time.
10. ACCESS, ACCURACY AND SECURITY
a. Platform access is subject to Mealgaadi Partner business hours. We don’t guarantee uninterrupted, error-free, or virus-free access.
b. Compatibility with your hardware is not guaranteed, and we are not liable for any damage.
c. We reserve the right to suspend or withdraw access at any time without notice.
11. INTELLECTUAL PROPERTY
a. Intellectual Property Rights (IPR) related to the Platform are owned or licensed by Trendonix Infotech Private Limited.
b. Limited personal use of Platform materials is allowed. Commercial use requires a license.
12. THIRD PARTY CONTENT
We are not responsible for users’ compliance with rules. You assume risk when accessing external links, and we may disable links to third-party sites.
13. LIMITATION OF LIABILITY
We and our representatives are not liable for any direct, indirect, special, or punitive damages. Our total liability or maximum liability in any possible case or scenerio will not exceed the value of your order. These exclusions and limitations of liability will apply to the fullest extent permitted by law and will survive cancellation or termination of your Mealgaadi Membership.
14. SEVERABILITY
If any provision of this Terms of Use is deemed invalid, the remaining provisions remain valid.
15. ASSIGNMENT
You cannot assign your obligations under this Terms of Use to any other person/third party.
16. FORCE MAJEURE
We shall not be liable for any failure and/or delay on its part in performing any of its obligations under this Terms and Conditions and/or for any loss, damage, costs, charges and expenses incurred and/or suffered by the customer by reason thereof if such failure and/or delay shall be result of or arising out of Force Majeure Event set out herein. Explanation: ‘Force Majeure Event’ means any event due to any cause beyond the reasonable control including, without limitation, unavailability of any communication system, sabotage, fire, flood, earthquake, explosion, acts of God, civil commotion, strikes, lockout, and/or industrial action of any kind, breakdown of transportation facilities, riots, insurrection, hostilities whether war be declared or not, acts of government, governmental orders or restrictions, breakdown and/or hacking of the Website and/or contents provided for availing the Products and/or services under the Website, such that it is impossible to perform the obligations under the Agreement, or any other cause or circumstances beyond the control of the Website hereto which prevents timely fulfilment of obligation of the Website hereunder.
17. GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION
a. This Agreement shall be governed by the laws of India without reference to conflict of law principles.
b. Subject to this clause, the courts of New Delhi shall have exclusive jurisdiction to determine any dispute arising out of or in relation to these Terms of Use.

19. GENERAL DISCLAIMER
a. The Platform may undergo upgrades, and functions may be temporarily non-operational.
b. Limitations may result in delays or omissions of third-party information.
c. We are not liable for losses due to the use of unauthorized credit or debit cards.
d. MealGaadi Partners and Pilots are third parties, and we are not liable for their actions.
e. Information on the Platform is provided on an AS IS basis, without warranties.
f. We are not liable for any loss or injury related to the information provided.
g. We are not liable for damages resulting from Services provided on the Platform.
